Robbery vs. Aggravated Robbery

If you’re convicted of robbery or aggravated robbery, you could be looking at years in prison, steep fines and a felony charge on your criminal record. This can hinder your ability to get a job, secure housing and maintain trust with your loved ones. Under Utah law, a person commits robbery if:

  • the person unlawfully and intentionally takes or attempts to take personal property in the possession of another from their person, or immediate presence, against their will, using force or fear, and with a purpose or intent to deprive the person permanently or temporarily of the personal property; or
  • the person intentionally or knowingly uses force or fear of immediate force against another in the course of committing a theft or wrongful appropriation

Robbery is a second-degree felony that carries a penalty of up to 20 years in prison and up to $10,000 in fines.

The law defines a person who commits aggravated robbery as:

  • A person commits aggravated robbery if in the course of committing robbery, they:
    • use or threaten to use a dangerous weapon, causes serious bodily injury upon another, or takes or attempts to take an operable motor vehicle.

Aggravated robbery is a first-degree felony that carries penalties of five years to life in prison and up to $10,000 in fines.

Defending Robbery Charges in Salt Lake City

While robbery accusations can be nerve-wracking, you must remember that there is hope. Over the past 20 years, Catherine Cleveland Attorney at Law has successfully protected those accused of robbery by working to reduce or dismiss their charges. As a judge pro tem, I have extensive insider knowledge of which defenses work and which ones fail. Thus, I know what it takes to win your case.

I can employ hard-hitting defense strategies against your robbery charges. They include:

  • Burden of proof: If the prosecution can’t prove your guilt beyond a reasonable doubt, then you may be innocent.
  • Lack of evidence: If the prosecution doesn’t have enough evidence to satisfy the burden of proof, you may walk away from your case innocent.
  • Intoxication: I can fight to prove that your good judgment was impaired by alcohol or drugs at the time of the alleged incident.
  • Innocence: You didn’t commit robbery, so you are not guilty.
  • Duress: You were under extreme threat of harm or death to commit robbery, and not committing the crime would be life-threatening for you.
  • You were the owner: The allegedly stolen property belonged to you, and thus, you are innocent.
  • Police misconduct: If an officer coerced you into making a false confession, failed to read your Miranda Rights, or failed to lawfully carry out your arrest for other reasons, your charges may be dropped entirely.

When facing robbery charges, you cannot take these matters lightly. You need me, Catherine Cleveland, to champion your best interests by devising an aggressive defense strategy backed by convincing details and effective negotiation techniques. I take your future seriously.
